Article 1 - Applicability

1. These General Terms and Conditions apply to all offers, agreements, orders, and all use of the website www.wescents.com.

2. By using our website and/or placing an order, you agree to these terms and conditions.

3. Wescents reserves the right to modify these terms and conditions. The current version is always available for consultation on the website.

Article 2 - Products and Information

1. Wescents sells niche perfumes and related products.

2. Product images and descriptions are approximate. Minor deviations may occur.

3. All products are 100% authentic and sourced from official suppliers.

4. An offer becomes void if a product is out of stock or in case of an obvious pricing error.

Article 3 - Prohibited Uses
In using our website, you agree not to:

1. Use the site for any unlawful purpose or in a way that infringes upon the rights of others.

2. Introduce viruses, Trojan horses, worms, or other malicious code.

3. Attempt to gain unauthorized access to any part of the website, its systems, or networks.

4. Use any automated system, including "robots," "spiders," or "offline readers," to access the website for any purpose without our express written permission.

5. Take any action that imposes an unreasonable load on our infrastructure.

Article 4 - Intellectual Property

1. All content on this website, including but not limited to text, graphics, logos, images, audio clips, and software, is the property of Wescents or its content suppliers and is protected by Dutch and international intellectual property laws. Certain visual content on this website has been digitally enhanced or adapted with the assistance of artificial intelligence. These modifications are intended solely for creative presentation and do not alter the characteristics of the products themselves. Please note that colours, proportions, packaging details, and other visual elements may vary slightly from the actual product.

2. You may not copy, reproduce, modify, distribute, or use any content from this website for commercial purposes without our express prior written consent.

3. By submitting any content to the website (such as product reviews), you grant Wescents a perpetual, royalty-free, and transferable license to use, modify, and display such content for any commercial purpose.

Article 5 - Prices and Payment

1. All prices are in euros, inclusive of VAT and exclusive of shipping costs.

2. Shipping costs are clearly displayed during the checkout process.

3. Payment is possible via the methods offered in the webshop.

4. Wescents reserves the right to refuse or cancel orders in case of payment issues, suspected fraud, or incorrect information.

Article 6 - Orders and Order Confirmation

1. After placing an order, you will immediately receive an automatic order confirmation by email.

2. The purchase agreement is concluded at the moment your payment has been received and we have sent you an order confirmation.

3. If a product is unexpectedly unavailable, we will inform you and refund the amount.

Article 7 - Shipping and Delivery

1. Orders are typically shipped within 1-3 business days after payment.

2. Delivery times are indicative and depend on the destination and carrier.

3. After shipment, you will receive – where available – a track-and-trace code.

4. The risk of damage or loss transfers to the customer upon delivery.

5. Additional shipping costs may be charged for incorrectly provided addresses.

Article 8 - Right of Withdrawal and Returns
Perfumes fall under hygiene-sensitive products. Special rules apply to these.

8.1 Return Policy

• Returns are possible within 14 days of receipt of the product, provided:

• The product is unused and unopened.

• The seal is intact.

• The original packaging is undamaged.

• Pursuant to Article 6:230p (intro and subsection e) of the Dutch Civil Code, you do not have a right of withdrawal for products which, by their nature, cannot be returned, such as perfumes where the seal has been broken.

• Used products, testers, samples, or products with damaged packaging cannot be returned.

8.2 Defective or Incorrect Items

• For a damaged, defective, or incorrectly delivered product:

• Report this within a reasonable period after discovery, and at the latest within the legal guarantee period.

• Provide clear photos as evidence.

• Wescents will replace the product or refund the purchase.

8.3 Refunds

• Refunds are processed within 7 business days of receiving and inspecting the returned product.

• Return shipping costs are the customer's responsibility, unless the fault lies with Wescents.

• Shipping costs are non-refundable.

Article 9 - Warranty

1. Wescents guarantees that all products are authentic and new.

2. In addition to the conformity guarantee, the law provides a statutory guarantee period of two years.

3. Damage caused by the customer's own actions (e.g., dropping, heat, improper use) is excluded.

4. Natural colour changes of perfume over time are normal.

Article 10- Liability

1. Wescents is not liable for damage resulting from incorrect or unsafe use of the products.

2. Wescents is not liable for the temporary unavailability of the website, or for any loss or damage arising from the user's inability to use the site. Wescents does not guarantee that the website will be free from bugs, viruses, or other harmful components.

3. Wescents is not liable for indirect damages, such as lost profits.

4. The maximum liability of Wescents is limited to the invoice value of the relevant order.

Wescents processes personal data in accordance with the GDPR. See our Privacy Policy for details.

Article 12 - Force Majeure
Wescents is not liable for delays or non-performance due to force majeure, including strikes, system failures, natural disasters, or issues with transport partners.

Article 13 - Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.

Article 14 - Entire Agreement
These Terms & Conditions, together with the Privacy Policy and any order confirmation, constitute the entire agreement between you and Wescents concerning the use of the website and the purchase of products, and supersede all prior agreements and understandings.

Article 15 - Governing Law and Disputes

1. These terms and conditions are governed by Dutch law.

2. Disputes will initially be submitted to the competent court in Amsterdam.

3. Additionally, consumers have the option to submit a dispute to the Thuiswinkel Disputes Committee (Foundation for Consumer Dispute Committees), PO Box 90600, 2509 LP The Hague (www.degeschillencommissie.nl).
